White House Opposes Surveillance... Of Its Own Surveillance Policy

Since it was formed in 2004, on the recommendation of the 9/11 Commission, The Privacy and Civil Liberties Oversight Board has been blasted by civil libertarians
as a tool of the administration, more interested in whitewashing War on
Terror–related privacy violations than serving as a genuine check on
government intrusion. One of the board's five members even resigned in protest,
citing among other things "the vast array of alphabet soup agencies and
bureaucracies in the national security apparatus" that sought "to control and modify the Board's public utterances."
So last year, Congress sought to give the board greater autonomy by
moving it out from under the aegis of the White House and
reconstituting itself as an independent boad within the executive
branch. The response of the White House, Wired reports, has been to drag its feet in appointing a new board -- meaning there is no one on the board as of January 30th -- prompting bipartisan criticism from top members of the Senate's Homeland Security Committee.



The board's second annual report
(pdf), released late last month, does not exactly inspire confidence in
its assiduousness as a privacy watchdog -- even when staffed. After
touting its excellent working relationship with the White House, it
moves to a "nothing to see here" review of the post-9/11 use of the
material witness statute (MWS) as a detention tool. Aside from one
"terrible mistake," the report asserts the board "was not made aware of
specific problems with the use of the MWS in the anti-terrorism
context" and cites a claim by the Justice Department that "on only nine
occasions since the attacks of September 11, 2001 has the MWS been used
in terrorist-related investigations." That is hard to square with the
findings of a joint report by Human Rights Watch and the American Civil Liberties Union,
which found some 70 instances of 9/11-related detention, though the
discrepancy may be explained by the frequent use of immigration
violations as a pretext for detentions that were actually related to
terror investigations.

He's been a strong proponent of cracking down on whatever he considers indecent programming, and much of his support for a la carte cable is based on how it might block indecent content. The latest crackdown on indecency has a number of people shaking their heads. It involves fining ABC affiliates $1.43 million for a brief clip of the TV show "NYPD Blue," that aired in February of 2003, and included images of a naked woman from behind. ...

By now, most people would have forgotten about it... unless, of course, the FCC were to bring the clip back into the news, getting someone to put it on YouTube, and driving well over a million viewers to watch the video since the fine was announced.

I think I would consider this clip more funny than indecent; in fact its not indecent in the slightest. Kevin Martin needs to get a life.

Coal Ash Is More Radioactive than Nuclear Waste

Coal, meanwhile, is believed responsible for a host of more quotidian problems, such as mining accidents, acid rain and greenhouse gas emissions. But it isn't supposed to spawn three-eyed fish like Blinky.

Over the past few decades, however, a series of studies has called these stereotypes into question. Among the surprising conclusions: the waste produced by coal plants is actually more radioactive than that generated by their nuclear counterparts. In fact, fly ash—a by-product from burning coal for power—contains up to 100 times more radiation than nuclear waste.

At issue is coal's content of uranium and thorium, both radioactive elements. They occur in such trace amounts in natural, or "whole," coal that they aren't a problem. But when coal is burned into fly ash, uranium and thorium are concentrated at up to 10 times their original levels.

Researchers at the Max Planck Institute for Human Cognitive and Brain Sciences in Leipzig, Germany have found a genetic factor that affects our ability to learn from our errors. The scientists demonstrated that men carrying the A1 mutation, which reduces the amount of dopamine D2 receptors in the brain, are less successful at learning to avoid mistakes than men who do not carry this genetic mutation. This finding has the potential to improve our understanding of the causes of addictive and compulsive behaviors.

"The Motley Fool investment Web site warns investors to beware
of 'Sony, BMG, Warner Music Group, Vivendi Universal, and EMI.' In an
article entitled 'We're All Thieves to the RIAA,' a Motley Fool
columnist, referring to the RIAA's pronouncement in early December in Atlantic v. Howell,
that the copies which Mr. Howell had ripped from his CDs to MP3s in a
shared files folder on his computer were 'unauthorized,' writer Alyce

Gandalf_the_Beardy writes in with news that's been around a while but is getting more attention lately. Last month Benjamin Googins, a security researcher at CA, determined that Sears Holding Corp. installed ComScore spyware without adequate disclosure.
Sears said, yes we tell people about tracking their browsing. On Jan. 1 spyware researcher Ben Edelman weighed in, noting that Sears' notice occurs on page 10 of a 54-page privacy statement,
and twits Sears because its installation identifies the software as "VoiceFive" and later claims it's coming from a company called "TMRG, Inc." even though a packet sniffer confirms the software belongs to ComScore, adding "These confusing name-changes fit the trend among spyware vendors."
